Terms of Service

1. Purpose
These Terms of Service (hereinafter "ToS") govern access to and use of the IliaCloud platform, available at app.iliacloud.com.
IliaCloud is a SaaS (Software as a Service) server management platform that allows users to connect, monitor and manage their remote servers through an intuitive web interface. The platform includes monitoring, Docker management, SSH terminals, backups, alerts and artificial intelligence assistance features.
Any registration or use of the platform implies unreserved acceptance of these ToS.
2. Registration
Access to IliaCloud requires the creation of a user account. Registration is done through a form requiring a valid email address and a password.
- Only one account is permitted per individual or legal entity.
- The user is responsible for keeping their login credentials confidential.
- The user agrees to provide accurate information and to keep it up to date.
- Any activity carried out from an account is deemed to have been performed by its holder.
- In case of suspected unauthorized use, the user must immediately notify IliaCloud at contact@iliacloud.com.
3. Services offered
IliaCloud offers four subscription plans:

Detailed features for each plan are described on the platform's pricing page. IliaCloud reserves the right to modify plans and pricing, subject to prior notification to users.
4. Payment
Payments are processed securely by Stripe. IliaCloud does not store any banking data.
- Recurring billing, monthly or annual at the user's choice.
- Payment is automatically charged at the beginning of each billing period.
- Cancellation takes effect at the end of the current billing period. The user retains access to paid features until that date.
- No refund is issued for a period already started, unless required by applicable law.
- In the event of a payment failure, IliaCloud reserves the right to suspend access to premium features after notification by email.
5. Personal data
IliaCloud collects and processes the following personal data in order to provide the service:
- Email address — identification and communication
- IP address — security and logging
- Audit logs — traceability of actions on the platform
- SSH keys and API keys — encrypted with the AES-256-GCM algorithm before storage

6. Liability
IliaCloud is a management tool that allows users to administer their own servers. As such:
- Commands executed on connected servers are under the sole responsibility of the user.
- IliaCloud shall not be held liable for damages resulting from commands executed through the platform, including commands suggested by artificial intelligence.
- The user is responsible for the security of their servers and the backup of their data.
- IliaCloud implements reasonable measures to ensure the security of the platform, but does not guarantee the complete absence of security vulnerabilities.
7. Use of artificial intelligence
IliaCloud integrates artificial intelligence features to assist users in managing their servers.
- The system operates on a BYOK (Bring Your Own Key) model: the user provides their own API key from the AI provider of their choice.
- Requests transit through IliaCloud's servers before being relayed to the AI provider selected by the user.
- IliaCloud does not store conversations with the AI. Exchanges are processed in real time and are not retained.
- AI suggestions are provided for informational purposes only. The user remains solely responsible for executing any suggested commands.
- AI provider API keys are encrypted with AES-256-GCM before storage.
8. Availability
IliaCloud strives to ensure service availability 24/7, on a best-effort basis.
- Service interruptions may occur for maintenance, updates or force majeure reasons.
- Scheduled maintenance will be communicated in advance where possible.
- No availability guarantee is offered for the Free plan.
- Paid plans benefit from a 99.5% availability target, excluding scheduled maintenance and force majeure events.
9. Termination
The user may request the deletion of their account at any time from the platform settings or by contacting contact@iliacloud.com.
- Account deletion results in the irreversible deletion of all associated data (registered servers, keys, configurations, logs).
- IliaCloud reserves the right to suspend or delete an account in case of abuse, violation of these ToS or illegal activity.
- In case of suspension, the user will be notified by email and will have 15 days to contest the decision.
10. Intellectual property
All source code, interface, text, graphics and visual elements composing the IliaCloud platform are the exclusive property of the publisher. Any unauthorized reproduction, modification or distribution is prohibited.
Data entered by the user (configurations, keys, server information) remains the property of the user. IliaCloud does not acquire any rights over this data beyond what is necessary to provide the service.
11. Changes to the Terms of Service
IliaCloud reserves the right to modify these ToS at any time. Users will be notified of any substantial changes by email notification at least 30 days before the new terms take effect.
Continued use of the service after the changes take effect constitutes acceptance of the new ToS.
12. Governing law and jurisdiction
These ToS are governed by French law.
In the event of a dispute relating to the interpretation or performance of these ToS, the parties agree to seek an amicable solution before any legal proceedings.
In the absence of an amicable agreement, any dispute shall be subject to the exclusive jurisdiction of the competent courts in France.
